Non-competition bans can exacerbate this problem by preventing workers from coming out on their own to create competing businesses. Some academic studies find that entrepreneurs create start-ups at lower rates and have a harder time attracting employees to jurisdictions that strictly enforce these types of agreements14.14 Provided that everyone thinks the terms of the non-competition agreement are fair, both parties can sign them.
